1. Introduction and Scope

Mindfulness Roots Counseling LLC, doing business as Tampa Counseling and Wellness (“we,” “us,” or “our”), respects your privacy. This Privacy Policy explains what information we collect through this website and our related communications, how we use it, who we share it with, and the choices available to you. This Policy applies to this website and to the forms, calls, and text messages associated with it. It does not replace the Notice of Privacy Practices that governs Protected Health Information for established clients under HIPAA. Where the two differ with respect to Protected Health Information, the Notice of Privacy Practices controls. By using this website or submitting information through it, you agree to the practices described in this Policy.

2. Information We Collect

2.1 Information You Provide Directly

When you complete a form, call us, or message us, we may collect:
  • First and last name
  • Email address
  • Mobile or landline phone number
  • The service you are interested in
  • Any message or notes you choose to include
  • Your consent selections, including consent to receive text messages

2.2 Protected Health Information (PHI)

Protected Health Information is collected only within the clinical relationship, after you become a client, and is governed by HIPAA and our Notice of Privacy Practices. Please do not include detailed health information, diagnoses, or clinical details in website forms, text messages, or email. Those channels are not intended for Protected Health Information and are not a secure method of transmitting it.

2.3 Information Collected Automatically

When you visit the website, we and our analytics providers may automatically collect:
  • IP address and general geographic location derived from it
  • Browser type, device type, and operating system
  • Pages viewed, time spent on each page, and links clicked
  • The page you were on when you submitted a form
  • The website or advertisement that referred you
  • Date and time of your visit

2.4 Marketing and Attribution Data

To understand which marketing efforts are effective, we record campaign identifiers that appear in the web address you arrive on, including Google click identifiers, Meta click identifiers, Microsoft click identifiers, and campaign, source, medium, term, and content parameters. This data describes the advertisement or link you clicked, not your health.

3. How We Use Your Information

We use the information described above to:
  • Respond to your inquiry and answer your questions
  • Schedule, confirm, reschedule, or remind you about appointments
  • Send you text messages and emails you have asked to receive
  • Verify eligibility and coordinate services
  • Operate, maintain, secure, and improve this website
  • Measure the performance of our advertising and marketing
  • Detect and prevent fraud, abuse, and spam submissions
  • Comply with legal, regulatory, and professional obligations
We do not sell your personal information. We do not use Protected Health Information for advertising or marketing purposes.

4. HIPAA and Protected Health Information

If you become a client, your Protected Health Information is safeguarded under the Health Insurance Portability and Accountability Act. We apply the administrative, physical, and technical safeguards required by federal law. We do not disclose Protected Health Information without your written authorization except where permitted or required by law, including for treatment, payment, and health care operations, or in response to a valid legal process. Information you submit through a website form before becoming a client — such as your name, phone number, email address, and the service you are interested in — is treated as contact and inquiry information. We handle it confidentially, but it is not the same as Protected Health Information created within a clinical relationship. You may request a copy of our Notice of Privacy Practices at any time by contacting us at livewell@tampacw.com.

5.3 Message Frequency

Message frequency varies depending on your interaction with us and the purpose of the message.

5.4 Message and Data Rates

Message and data rates may apply. These charges come from your mobile carrier, not from us. Contact your carrier for details about your plan.

5.5 How to Opt Out

Where a provider handles Protected Health Information on our behalf, we require a Business Associate Agreement as required by HIPAA.

8. Data Retention

We keep information only as long as needed for the purposes described in this Policy, or as required by law and professional recordkeeping obligations. Clinical records are retained for the period required under Florida law and applicable professional standards.
